AI Processing Disclosure

Our Platform produces machine-generated visual outputs. Outputs are software products, not professional opinions, and they are not certified or warranted as MLS-, brokerage-, or jurisdiction-compliant. You alone are responsible for reviewing every output before using it and for making all disclosures required by your MLS, brokerage, or applicable law.

This AI Processing Disclosure (the “Disclosure”) explains, at a high level, how automated and machine-learning technologies are used within the Better Listing Media platform (the “Platform”). It is incorporated into and governed by our Terms of Service and applies to every user.

1. Outputs are machine-generated and AI-assisted

The Platform uses statistical machine-learning models to generate visual outputs from the source media you upload. Editing functions include HDR merging, virtual twilight, virtual staging, sky replacement, object removal, image optimization, and related processing. Some functions are fully automated; others combine multiple automated steps in sequence.

Output generation may include, without limitation, deletion of content present in the source image, generation of content not present in the source image, color and exposure transformations, recomposition of scene elements, and synthesis of new sky, lighting, or staging elements.

2. We do not disclose our methods, models, or providers

For competitive, security, and integrity reasons, Better Listing Media does not publish, and will not disclose to customers or the public, the specific machine-learning models, model versions, training data sources, processing partners, pipelines, prompts, or proprietary techniques that we use to produce outputs. Our pipeline is a trade secret of Better Listing Media. You expressly waive any claim or right of action against us based on our refusal to disclose this information.

3. NO claim of MLS, brokerage, or jurisdictional compliance

The Platform does not certify, guarantee, or warrant that any output complies with the rules of the National Association of Realtors, any state, local, or regional MLS, any brokerage, any state real-estate commission, any federal or state advertising statute, any fair-housing law, or any other regulatory regime.

Rules for AI-altered, synthesized, virtually staged, virtually decluttered, twilight-converted, or sky-replaced real-estate imagery vary materially by jurisdiction and change frequently. Some jurisdictions and MLSs prohibit specific edits entirely (for example, certain virtual-staging or sky-replacement edits without disclosure). It is your responsibility — and not ours — to determine which edits are permitted in your market, how they must be labeled, and whether a listing disclosure is required.

4. Customer is the sole reviewer

You are the sole reviewer of every output before publication, transmission to any third party, or use in real-estate marketing. You agree to:

  • visually inspect each delivered file for accuracy, artifacts, hallucinations, missing or added objects, misrepresented finishes, or other defects;
  • compare the output to the original source to confirm material features of the property are honestly represented;
  • add any disclosure language required by your MLS, brokerage, state real-estate commission, or applicable advertising rules; and
  • retain the source files (independently of the Platform) for the period required by your record-keeping obligations.

If you publish an output without independent review, you do so entirely at your own risk.

5. Outputs are not professional opinions

The Platform is software. It does not render legal, real-estate, brokerage, appraisal, insurance, regulatory, fair-housing, or marketing opinions or advice. No statement by us — in product copy, marketing material, support communication, AI-generated copy, or anywhere else — should be construed as professional advice. You should consult appropriate licensed professionals for guidance specific to your business.

6. AI output limitations — non-exhaustive list

You acknowledge that AI outputs may, without limitation:

  • contain visual artifacts, distortions, or hallucinations;
  • remove, add, or alter visible objects in ways the source did not depict;
  • misrepresent the size, finish, color, material, or condition of property features;
  • fail to match a previous output even when given identical inputs (model nondeterminism);
  • produce different results across customers, sessions, or model updates;
  • be unsuitable for certain image conditions (low light, motion blur, mixed lighting, complex reflections, water, snow, or unusual scene geometry); and
  • produce results inconsistent with industry, MLS, or jurisdictional norms.

None of these conditions constitutes a defect entitling you to a refund (see our Refund & Reprocessing Policy).

7. No training on your media

Subject to the limited internal-monitoring exception below, we do not use customer source media or finished outputs to train, fine-tune, or generate datasets for any AI model, by us or by any processing partner. We may compute fully anonymized, non-image quality-monitoring metrics (e.g., aggregate processing time, error rate) on internal samples.

If we ever wish to use opt-in samples for product improvement, we will obtain affirmative, opt-in consent from the affected customer first.

8. Data handling during processing

The Platform transmits the minimum image data necessary to perform the requested edit to the processing infrastructure we operate. We do not transmit your account name, email address, billing information, brokerage name, end-client information, or any other personal information to processing partners. 9. Beta and experimental features

We may make experimental or beta features available from time to time. Such features are expressly provided “AS IS” and “AS AVAILABLE,” with no warranty of any kind, and may be modified, restricted, withdrawn, or discontinued at any time without notice. Output quality on beta features may be materially below the quality of our generally available services.

10. Service changes

We may, at any time and without prior notice, modify, add, deprecate, or remove AI features; swap underlying models or providers; change pipeline configurations; or alter output behavior. Continued use of the Platform after any such change constitutes acceptance of the modified service.

11. Disclaimer of warranties and limitation of liability

All disclaimers, warranty exclusions, and liability limitations set out in Sections 17 and 18 of our Terms of Service apply with full force to the AI processing described in this Disclosure. Without limiting those sections, you acknowledge that you have read the “AS IS” and limitation-of-liability provisions and accept them as a material condition of your use of the Platform.

12. Indemnification

You will defend, indemnify, and hold Better Listing Media harmless from any third-party claim arising out of your use, distribution, or misrepresentation of any AI output — including any claim by an end client, MLS, brokerage, regulator, consumer-protection agency, or rights-holder — on the same terms set out in Section 20 of our Terms of Service.
