Media Licensing Policy

Better Listing Media is an editing service. We process photos you bring to us — we don't shoot them, and we don't claim ownership of the work that flows through our pipeline. This policy explains how that breaks down legally so there's no ambiguity.
1. You own your source photos
The photos you upload to the Platform are yours. We make no ownership claim on your source files. By uploading you are simply granting us a limited license to process those files (see Section 3 below).
You represent and warrant that you have the rights necessary to upload and edit each file — either because you took the photo, you commissioned it under a work-for-hire agreement, or you have written permission from the rights-holder.
2. You own the edited output we deliver
The AI-edited photos we return to you are also yours. We claim no ownership in any deliverable. You can use the edited files for marketing, MLS listings, social media, brochures, websites, printed materials, or any other lawful purpose without paying additional royalties.
The license is yours to relicense to your clients (e.g. an agent or homeowner you shot for). The terms of any such sublicense are between you and them — we're not a party to it.
3. The limited license you grant us
You grant Better Listing Media a non-exclusive, worldwide, royalty-free license to:
- store your source files in our encrypted object storage (Cloudflare R2)
- transmit your source files to the third-party AI providers we use for processing (see our Privacy Policy)
- create intermediate working copies (masks, decoded JPEGs from RAW files, color-corrected variants) needed to produce the final edited output
- serve the finished output to you for download and, if you use white-label delivery, to the client you specify
- keep operational backups for a reasonable period
This license is the minimum we need to deliver the service. It expires automatically when the relevant files are deleted from our system per our retention policy (30 days for source files and intermediates, 90 days for finished deliverables — see the Privacy Policy for details).
4. We do not train AI on your photos
We do not use customer source media or delivered output to train AI models, fine-tune models, or generate aggregated training datasets — by us or by any of our processing partners. The partners we work with are bound by written agreements that prohibit training on or retaining the media we transmit to them on your behalf.
If we ever want to use anonymized samples for genuine product-improvement research, we will obtain explicit opt-in consent from individual customers first.
5. Sample media for marketing
From time to time we want to show prospective customers what our service looks like — on the home page, in social posts, in pitch decks, in case studies, or on comparison pages. We do not use your delivered work for any of this without your explicit written permission.
The before/after pairs you see on betterlistingmedia.com are either (a) our own internal test shoots, (b) provided by photographers under a signed release, or (c) clearly licensed stock. If you ever recognize one of your shots in our marketing and don't remember giving us permission, email support@betterlistingmedia.com and we'll remove it immediately.
6. Sublicenses to your clients
When you deliver edited photos to your end client (an agent, a homeowner, a builder), the license terms between you and that client are governed by your own contract — not by Better Listing Media. If you use a generic license, we recommend specifying:
- which property the photos may be used to market
- whether the license is exclusive or non-exclusive
- whether it covers MLS use, social media, print, or all of the above
- whether the license transfers if the listing changes brokerage
This is standard photographer practice; it has nothing specifically to do with the AI edit. We mention it because our customers often deliver via our white-label pages and ask.
7. Removed content and rights complaints
If you upload media that violates a third party's copyright, we will remove it upon a valid DMCA notice as described in our DMCA Copyright Policy. Repeated infringement may result in account termination.
